What is a loan modification?

A loan modification is a permanent change in the current parameters of an existing mortgage loan. This change is made by a lender in response to a homeowner’s long-term inability to repay the loan under the existing conditions. Typically, this involves a reduction in the interest rate and payment of the loan, a different type of loan, an extension of the loan term, or any combination of the three. A loan modification agreement is different from a forbearance agreement.

A Forbearance provides short-term relief for homeowners who have temporary financial difficulties, while a loan modification agreement is a long-term solution for homeowners who are struggling to repay their mortgages due to financial hardship. Your lender must still approve the terms of the loan modification.



Our legal process

Our process in working on your case is simple. First, we send you our client package. We ask that you complete this package as soon as possible and return it with your loan documents. Upon receipt of your client package, we will assign one of our legal teams to review your file immediately in order to evaluate your case. Once accepted, we will contact your mortgage lender to notify them that our law firm will be acting as the attorney of record in the note restructuring process. At this time, we simultaneously conduct a Forensic Loan Audit on your mortgage documents. With this audit, our compliance review department looks for civil law violations that your lender may have committed upon closing your loan. We then use these violations in an attempt to obtain a loan restructuring. If our negotiations are accepted, you will then sign the new documents, agreeing to the terms and conditions of your modified mortgage loan.
